Can Missouri Party Host Be Held Responsible For Drunk Driving?

A Missouri court is examining if the host of a party where alcohol is served can be charged in connection to crimes committed by intoxicated guests. According to ABC News, a 46-year-old Kansas City, Missouri, woman has been charged with second-degree involuntary manslaughter after a drunk driver left a party at her home and was involved in a fatal car accident.

The crash happened on Halloween night in 2009. A 19-year-old man, who had been served numerous drinks at the party, collided on his way home with a car driven by a 16-year-old girl, killing her.

In Missouri, the host of a party cannot be held liable for the actions of their guests, but prosecutors have brought the charges against the woman alleging that she served the drinks herself to a known minor, and then let him get in the car and leave knowing that he was intoxicated. Prosecutors also pointed out a similar case in Pennsylvania where a court of appeals had upheld a woman’s conviction under the same circumstances.

Defense attorneys argued that the charge should be dismissed on the grounds that, “Furnishing alcoholic beverages is not the proximate cause of injuries by intoxicated persons.” A judge is expected to make a decision in the coming weeks.

Teen Requires Heart Transplant After Tackle By School Security

Questions are swirling around an incident that left a Normandy, Missouri, teenager with a failing heart. Reports from KSDK 5 News say that the incident occurred outside of Normandy High School on October 21 around 8:00 a.m.

The teen’s grandmother had just dropped him off at school and in fear of being late for class; he sprinted past a security guard. The guard gave chase and caught up to the boy, leading to the moment that caused the Slip and Fall Injury.

The guard says that as he grabbed the teen, the two slipped and he fell on top of the teen. The young man has a different version of the story, though. He claims that the security guard jerked him by the back of the shirt so hard that he fell backwards and once on the ground, the security guard plowed his knee into the teen’s chest, rupturing his heart.

The teen has spent several weeks in an intensive care unit at a local hospital and has undergone numerous surgeries. He is now suffering from symptoms of congestive heart failure and has been placed on a list to undergo a heart transplant since part of his heart has stopped working.

Report Of Nursing Home Abuse In St. John, Missouri

Nearly 6 million claims of elderly abuse or neglect were reported in 2010, and as the population of individuals over the age of 65 continues to increase, experts believe the number of abuse cases will do the same.

KMOV 4 News, in St. John, Missouri, reported one recent case of abuse last week after an 82-year-old woman was hospitalized with what appeared to be bruises from beatings. Police say they were called to St. John’s Place Nursing Home on June 2 after the victim’s daughter reportedly found the bruises on the woman’s abdomen and limbs. The victim spent the next two days in a local hospital having her injuries treated.

Police have begun an investigation into the incident and are currently interviewing all staff at the nursing home that may have come into contact with the victim.

Statistics show that more than 90 percent of nursing homes in the U.S. lack adequate staff to care for the number of patients living in the facility, and more than one-third of all nursing homes have been in violation of abuse and neglect laws in the past.

The National Highway Traffic and Safety Administration (NHTSA) says that approximately 30 percent of all fatal accidents involve a person who wasn’t wearing a seat belt.

Take, for instance, a 33-year-old woman who was killed in St. Genevieve, Missouri over the weekend. According to KSDK 5 News, the accident happened around 2:30 a.m. Sunday morning as she was driving east on Route JJ. As she rounded a corner in the road, the vehicle veered off the highway and struck a tree. The woman was not buckled in and was partially ejected from the vehicle. She died several hours after being transported to a local hospital.

The number of accidents and deaths associated with children utilizing safety seats are even more staggering, with the NHTSA finding that nine out of 10 seats aren’t properly installed. These findings prompted the organization to begin running a series of public service announcements in 33,000 targeted areas across the country to educate the public on the importance of choosing the right safety seat for your child. Also, the organization has launched a new website called Parents Central that offers information on how to keep children safe in and around vehicles.
