Couple Files Wrongful Death Lawsuit For Botched Child Birth

October 16, 2012
A couple from Creve Coeur, Missouri, recently filed a wrongful death lawsuit in St. Louis County Circuit Court against two doctors who they claim are responsible for the death of their son.
The Creve Coeur Patch said that in February 2011, the couple was told their unborn son would need to be delivered via cesarean section due to the significant size of the infant’s abdomen; however, during the delivery process a month later, the other doctor refused to perform the cesarean procedure and insisted on a vaginal birth.
Despite their objections and protest, the vaginal birth began, but the child became stuck in the birth canal. In the process of trying to free the child though, the doctor detached the child’s skull from the spinal column. The doctor then attempted to push the child back into the birth canal and the cesarean section was performed. The child was dead after being delivered.
The St. Louis wrongful death lawsuit that was filed shortly after the incident claims the doctors and their facilities were negligent in their care and the doctor attempted to hide the child’s injuries. The couple is seeking compensation for medical and funeral expenses along with punitive damages.
The St. Louis Personal Injury Lawyers with Cofman Townsley Injury Lawyers hope a decision in this case will help bring some closure to this tragic loss for the couple.
