State and Federal Wage and Hour Laws

The Fair Labor Standards Act (FLSA) requires employers to pay workers a minimum wage and overtime pay when they work more than 40 hours per workweek. State laws in Missouri and Illinois add additional requirements for employers.

Missouri

  • Most employers in Missouri are required to pay workers a state minimum wage of $7.50 an hour or a federal minimum wage of $7.25 an hour—whichever results in higher pay for the employee.
  • Retail or service businesses with less than $500,000 in gross income per year are not required to pay state or federal minimum wage.
  • Most workers in Missouri are also entitled to at least 1.5 times their normal pay after working more than 40 hours per workweek.

Illinois

  • Most employers in Illinois are required to pay workers a state minimum wage of $8.25 an hour or a federal minimum wage of $7.25 an hour—whichever results in higher pay for the employee.
  • Illinois requires employers to give each employee at least 24 continuous hours of rest per calendar week unless a permit is obtained allowing employees to voluntarily work seven days per week.
  • Most Illinois workers are also entitled to at least 1.5 times their normal pay after working more than 40 hours per workweek.
  • Employers must provide 20-minute meal breaks to employees for every continuous 7.5 hours worked.
